Rulings about Aggressed Muslims in Non-Muslim Countries It is clear to anyone interested in the Muslim minorities living in non-Muslim countries that many of these minorities are confronted with many trials and hindrances from following the way of Allah. In some cases, they undergo many types of aggression. They are killed publicly or assassinated covertly. Their money and belongings are stolen. Their mosques and religious books are attacked and their honor is defiled. All this happens under the banner of unfounded slogans and false allegations that are often nothing but the latent rancor and deeply rooted hatred. So, the disbelievers do not refrain from scolding Muslims, expelling them, intimidating them, and even shedding their blood. Some Muslim minorities endure persecution and repression including besieging their language and culture. This led to the spreading of illiteracy, superstitious beliefs, ignorance and poverty among them. In fact, the regions where these Muslims live are neglected culturally, socially and medically. Muslims in India and Philippines are examples of this category. In addition, the non-Muslims spare no effort to limit the participation of Muslims in government. The door is closed to Muslims when it comes to occupying key governmental positions. If the situation is as stated, then what should Muslims do in such countries? There is a consensus among Muslim scholars that it is prohibited to kill the non-Muslims or harm their property if there is a covenant or pact of peace between them and the Muslims. Respecting such a covenant means enforcing the protection and peace of Muslims and in return doing the same to non-Muslims. However, if the ruler of the non-Muslims betrays the Muslims, takes their property and homes, puts them in jail without right, tries to turn them away from their religion, or if such acts were done by anybody acting on his behalf or with his knowledge and consent and he does not do anything to prevent this or stop it, then the Muslims who are being aggressed have to assess their ability and means and estimate the circumstances surrounding them. So, the most practical alternative is to remain patient and bear the harm and persecution due to their weakness. But they should not let such hardship influence their creed, otherwise they have to migrate to another land unless they cannot get away from the hands of the non-Muslims, or do not know the way out or cannot go because they lack the means. They might also prefer to stay and remain patient following an order of their Imams who might hope to achieve a greater benefit or avoid a worse blight. Another alternative is that these Muslims can -if able- get satisfaction by warding off the aggression, fighting those who fight them, thus standing as defenders of their religion, their souls and all that is related to them. If they take this stance, they should not go beyond it by harming those who did not actually participate in oppressing them, even if such people show their sympathy to what their fellow non-Muslims did to Muslims. This attitude is backed by evidence from Qur'an. Allah says: "Then whoever transgresses the prohibition against you, you transgress likewise against him. And fear Allah, and know that Allah is with the pious." (1-94) Those Muslims also might set themselves apart from those who are in conflict with them and declare a general war against those waging war against them because the pact they had with them was abrogated. So, they fight against all those who are participating in the war against them. The evidence for this is the following verse: Allah says: "And fight against the disbelievers collectively, as they fight you collectively" (9:36) It is also important to note that some Shari'ah (Islamic Law) rulings differ according to the circumstances. What is good in one place might not be good in another. In fact, those who are in charge of the Muslim affairs - leaders, Imams and scholars - appreciate the situation better and are more acquainted with the nature of the society, the benefits of Da'wah and the situation of the ruling body. So, they might think that having patience will bring more advantages and be the best cure for that situation, as they can judge the situation better than anyone outside the field.
